When a person is arrested and put in jail, the most urgent thing for the family is to get that person out. A regular bail application is filed in court to ask the judge to release the person while the case is still going on. The person does not have to stay in jail while waiting for the trial to finish.
Advocate Arvind Kumar handles regular bail cases in Patna High Court and also in the Supreme Court of India. He has years of experience in filing bail applications and knows exactly how to present the case before a judge.
What is Regular Bail?
Regular bail, also called bail under Section 437 or 439 of the Code of Criminal Procedure (CrPC), is given by the Sessions Court or High Court. It allows an accused person to stay outside jail and attend court hearings as a free person. The court sets certain conditions — like appearing in court on all dates and not leaving the city without permission.
When Can You Apply?
- After a person has been arrested and is in police custody or judicial custody
- When the police file a charge sheet (challan) in court
- When bail has been rejected by a lower court and you want to apply again in a higher court
- At any stage of the trial, if the situation has changed
What Documents Are Needed?
- Copy of FIR (First Information Report)
- Arrest memo or remand papers
- Identity proof of the accused (Aadhaar, voter card, etc.)
- Proof of residence — to show the accused has permanent ties to the area
- Any medical documents if the accused has a health issue
- Surety documents (for the person who will stand as guarantor)
What We Do
Advocate Arvind Kumar personally studies every bail case. He reads the FIR, looks at the charges, and builds strong arguments for why bail should be granted. He argues the case in court and follows up until the bail is decided. He also helps the client and family understand each step clearly.
Important: Bail is not guaranteed in every case. The result depends on the facts of the case, the charges, and the court’s decision. We always give honest advice about the chances before filing.
